Maxwell Conversations: Party Representation and Equal Treatment
Parties to arbitral proceedings assume without question that they have a right to be represented by persons of their choice. Does such a right exist and, if so, what are its guarantees? Allowing parties a right to choose whomever they wish to represent them may give rise to issues relating to differences in professional and legal traditions, standards of practice and ultimately a fair hearing. What law or standards govern the conduct of party representatives in arbitration? Does an arbitral tribunal, in respecting equal treatment of the parties, have a duty to ensure that each party is represented by party representatives of similar strength, skill and experience?

Join us as we explore these and other issues with Prof. Gabrielle Kaufmann-Kohler, Prof. Dr. Mohamed Abdel Wahab and Yoshimi Ohara in the next edition of Maxwell Conversations.
